Our legal services and special education attorneys help families to learn about and secure legal guardianship, special needs trusts and acquire legal representation for matters regarding special education, such as mediation, due process, and other legal matters regarding their child's educational rights.
Guardianship - Uncontested
Every child who reaches age 18 in the State of New Jersey is considered an adult, whether or not he or she has a developmental disability. When your loved one becomes 18, you no longer have the legal authority to make financial, legal and health care decisions on his or her behalf, even if you believe that he or she cannot make quality decisions. A legal guardian is a person (or persons) who receives court approval and legal authority to make all necessary decisions, in order to ensure the continuity of care and protection of your young adult.

Special Needs Trust
A special needs trust is a simple way to set aside funds or assets for the benefit of a person who is physically or mentally disabled. This type of trust is set up to ensure that certain needs of your loved one will be provided for currently or in the future, without affecting his or her ability to remain on, or qualify for, government benefits.
